These terms and conditions apply to the website https://audiothek.philo.at (hereafter “Audiothèque”). The Audiothèque is an archive of philosophical broadcasts, courses and lectures. By using the Audiothèque, you agree to be bound by these terms and conditions. Our privacy policy is part of these terms of use.
Who We Are
The Department of Philosophy (hereafter “we”) is an organisational unit of the University of Vienna. We operate the Audiothèque and are responsible for the processing of your data.

Use
You may only use the Audiothèque to listen to or watch philosophical broadcasts, courses, lectures or other materials.
If we authorise you to do so, you may also publish philosophical broadcasts, courses, lectures or other materials on the Audiothèque. We reserve the right to refuse or revoke such authorisations at any time and without giving reasons. We also reserve the right to block or delete broadcasts that you have published on the Audiothèque at any time and without prior warning or giving reasons.
You may not use the Audiothèque in such a way that you violate applicable law, the Guidelines for the Publication and Operation of Websites at the University of Vienna (German), or contractual obligations imposed on you, expose the technical infrastructure of the University of Vienna to an excessive load or disrupt the normal operation of this infrastructure.
In any case, you are prohibited from using the Audiothèque for commercial purposes, advertising products or services other than scientific works on the Audiothèque, or collecting, using, or passing on to third parties data of other users, including but not limited to addresses, telephone numbers, email addresses or other personal data that appear on the Audiothèque.
If we grant you the option of uploading files to the Audiothèque, you are also prohibited from uploading files that
- Infringe any copyright, patent, trademark or other intellectual property right or trade secret, or disclose any information the disclosure of which would constitute a breach of your confidentiality obligations;
- contain personal data of third parties, unless (a) the person concerned has reached the age of 18, (b) they have given their consent in writing and (c) you have sent us this declaration of consent.
We reserve the right to refuse or prohibit your use of the Audiothèque, in whole or in part, at any time without prior notice or giving reasons and to report misuse and violations of applicable law to the authorities. We may also continue to exercise these rights if we have not taken any action against previous violations of applicable law or these terms and conditions.
Remuneration
Use of the Audiothèque is free of charge. You do not have to pay a fee to listen to, watch or publish broadcasts, courses, lectures or other materials, nor are you entitled to remuneration if you do so.
Accounts
To publish broadcasts, courses, lectures or other materials via the Audiothèque, you need an account. We open accounts on request, but reserve the right to refuse such requests without giving reasons. We also reserve the right to block or close your account at any time and without giving reasons.
In order to manage an account for you, we need your name and an email address. You undertake to provide true, accurate and complete information when you open an account with the Audiothèque or apply to open an account. You may maintain and update this information yourself and agree to keep it true, accurate and complete. If you provide information that is fraudulent, untrue, inaccurate or incomplete, or if we have reasonable grounds to suspect that you have done so, we reserve the right to suspend or close your account without notice.
You must keep your password for the Audiothèque secret and are prohibited from passing it on to third parties.
You are responsible for all activities that occur in connection with your account or password. You agree to notify us immediately if you have reason to believe that a third party has obtained knowledge of your password or otherwise gained access to your account. You also agree not to authorise any other person to use your account.
You grant us and all other persons and organisations involved in the operation of the Audiothèque the right to collect, monitor, store, evaluate and pass on your data in connection with the operation of the Audiothèque. Personal data is subject to our privacy policy.
We do not wish to receive confidential information via the Audiothèque. Any material, information or other communication that you transmit to the Audiothèque or upload to the Audiothèque will be treated as non-confidential.
You can close your account at any time.
Intellectual property rights
The Audiothèque in its entirety is the property of the University of Vienna. All contents of the Audiothèque are the property of the University of Vienna or third parties. Unless otherwise stated by the respective rights holders, all rights are reserved. In particular, you may not exploit, reproduce, distribute, rent, lend, broadcast, perform, perform or present or make available broadcasts, courses, lectures or other materials from the Audiothèque, either individually or in their entirety, without the express consent of the respective rights holder.
If you upload broadcasts, courses, lectures, or other materials to the Audiothèque, you thereby grant us free of charge and non-exclusively the rights to reproduce them, distribute them, broadcast them, and make them available to the public as well as the right to transfer these rights to other organisations. You also declare that you are the owner of these rights and are authorised to transfer them to us. We need these rights to store and publish broadcasts, to deposit them in public archives and to advertise them via third parties.
We respect the rights of third parties. If you believe that content from the Audiothèque infringes your rights, please contact it.philosophy@univie.ac.at.
Availability
We do not guarantee that the Audiothèque will be available at all times. We may carry out maintenance work at any time and without prior notice, during which the Audiothèque may be unavailable. We would also like to point out that technical faults may occur at any time.
Disclaimer
The Audiothèque contains philosophical broadcasts, courses, lectures and materials that are made available to us by academics free of charge and which we in turn make available to the public free of charge. The Audiothèque may also contain links to websites owned or operated by third parties. We do not have the capacity to control the broadcasts, courses, lectures and materials that are made available to us. We also have no control over third party websites and are not responsible for their content. We therefore accept no responsibility for the accuracy, legality or morality of either the broadcasts, courses, lectures or materials that we publish or the websites to which we link. The fact that we publish a broadcast, course, lecture or some other material or that we refer to a website does not mean that we endorse its content or the organisations, works or ideas mentioned therein. If you use the Audiothèque or access websites to which we refer, you do so at your own risk. You irrevocably waive any claims against us in relation to the Audiothèque and third party websites.
Indemnification
You agree to defend, indemnify and hold harmless the University of Vienna, and all other individuals and entities involved in the operation of the Audiothèque, from and against all claims, damages, costs and expenses, including costs of legal representation, arising out of or relating to your use or misuse of the Audiothèque, including but not limited to violations of applicable law or these Terms by you or any third party using your account.
Final provisions
These terms and conditions apply until they are cancelled by one of the parties. If you no longer agree with the Audiothèque, its content or any of these terms and conditions, you must stop using the Audiothèque.
We may change these terms and conditions at any time. We will inform you of any changes by announcing them on the Audiothèque. The new terms will take effect as soon as they are published on this page. If you have an account on the Audiothèque, we will also inform you by email.
Should any of these terms and conditions be void, invalid or unenforceable, this shall not affect the validity and enforceability of the remaining terms and conditions.
